These general terms and conditions apply to all commercial transactions carried out in our online store. The language used by GISELA on the Website will be Spanish, without prejudice to the use of other languages, national or regional. GISELA is not responsible for the non-understanding or misunderstanding of the language of the Website by the user, nor for its consequences.
GISELA reserves the right to modify the commercial offer presented on the Website (changes in products, prices, promotions and other commercial and service conditions) at any time. GISELA makes every effort within its means to provide the information contained on the website completely, truthfully and without typographical errors. In the event that at any time there is any error of this type, at all times beyond the control of GISELA, it will proceed immediately to correct it.

To make a purchase, the user can choose among the different ways to send us his order:

- By telephone but only if the method of payment is cash on delivery.
Once the order has been placed, i.e. with the acceptance of the general terms and conditions and the confirmation of the purchase process, www.gisela.com will always send an email to the user confirming the details of the purchase (please check your spam folder if you do not receive the confirmation email).
B.7) Prices
All prices of the products indicated on the website include VAT and any other taxes that may apply. However, these prices do not include the shipping costs of the products, which are detailed separately and must be accepted by the user.
B.8) Applicable taxes
The prices of the products displayed on the website include the Value Added Tax (VAT) that, if applicable, may be applicable.
Purchases to be delivered within the territory of any of the member states of the European Union will be subject to VAT. Purchases to be delivered to territories of non-European Union member states, or to the Canary Islands, Ceuta or Melilla will be exempt from VAT.
B.9) Method of payment and shipping costs
The user agrees to pay at the time the order is placed (except with the cash on delivery payment method). The initial price shown on the website for each of the products offered will be added to the relevant shipping costs. In any case, these rates will be previously communicated to the user before formalizing the purchase itself.
If the order is placed by logging in, the purchase receipt corresponding to the purchase order will be available and can be viewed at www.gisela.com in the "My Account" section under "ORDERS AND RETURNS". If placed as a guest, the ticket or receipt will be the packing slip included in the package.
The user must pay the amount corresponding to his order by credit or debit card (visa, mastercard, american express and/or visa electron), by PayPal or cash on delivery.
The user must notify Diseño y Fantasía S.L. (GISELA) of any undue or fraudulent charge on the card used for purchases, by email or telephone, as soon as possible so that Diseño y Fantasía S.L. (GISELA) can take the appropriate steps.
Diseño y Fantasía S.L. (GISELA) works with the payment gateways of La Caixa and PayPal, which have the highest security measures commercially available in the sector. In addition, the payment process in these gateways works on a secure server using the SSL (Secure Socket Layer) protocol. The secure server establishes a connection so that the information is transmitted encrypted using 128-bit algorithms, which ensure that it is only intelligible to the user's computer and the payment gateway, thus, by using the SSL protocol is guaranteed:

B.10) Shipping and product delivery
Diseño y Fantasía S.L. (GISELA) undertakes to deliver the product in perfect condition to the address that the user indicates in the order form and that, in any case, must be within the peninsula and the Balearic Islands. In order to optimize the delivery, we thank the user to indicate an address where the order can be delivered within normal business hours.
Your order will be shipped to the delivery address you specify, provided it is within Spain (peninsula and Balearic Islands) or Portugal. This may be different from the buyer's address.
There is the option of delivery at a collection point, you can choose as a place to pick up your order nearby stores where you can pick up your package (wide opening hours). When the package arrives at the store, we will notify you by SMS so that you can pick it up (remember to bring your ID). In order to choose your Pickup Point you must first fill in the shipping address, thanks to your zip code we will locate the best list of options.
Diseño y Fantasía S.L. (GISELA) will not be responsible for errors caused in the delivery when the delivery address entered by the user in the order form does not match the reality or have been omitted.
The delivery time is between 1 and 3 working days from the moment you make your purchase.
For further information, it is important to note that the procedure during this time is as follows: confirmation of order validity, preparation of orders and shipment via express courier company (Correos Express). The day the order is on its way, Correos Express will communicate it to the user by sending an SMS confirming the departure from its warehouses and within 24 to 48 hours it should have been delivered to the address indicated at the time of purchase.
In the event that the user has selected the "Collection Point" option, he/she will receive a notice on the day the order is at the selected establishment. It will remain there for 15 days. After this period and if the user has not come to pick up the package, it will be automatically returned.
These deadlines are average, and therefore, an estimate. Therefore, it is possible that they may vary for logistical reasons or force majeure. In case of delays in deliveries, Diseño y Fantasía S.L. (GISELA) will inform its customers as soon as it becomes aware of them.
Each delivery is considered to have been made from the moment in which the carrier makes the product available to the user, which is materialized through the control system used by the carrier.
In the case of delays in the delivery of orders attributable to Diseño y Fantasía S.L. (GISELA), the user may cancel the order in accordance with the procedure described in the section "Return Procedure". Delays in delivery will not be considered in cases where the order has been made available to the user by the carrier within the agreed time and could not be delivered for reasons attributable to the user.
In the same SMS informing the user that the product has left Correos Express warehouses, the shipment number and the customer service number of the transport company responsible for the delivery are provided, so that, in case of any incident during delivery, the user can contact the company to resolve it.
If at the time of delivery the user is absent, the carrier will leave a receipt indicating how to proceed to pick up the package. 3 SMS will be sent to the user informing where and how he can pick up his package to ensure that the delivery takes place.
If after 15 working days after the delivery of the order has not been arranged, the package will be returned to the warehouses of Diseño y Fantasía S.L. (GISELA) and the user will be responsible for the shipping costs and the return of the goods to their origin, as well as any associated management costs. These costs will be deducted from the purchase price of the returned order, which will be refunded.
If the reason for the non-delivery is the loss of the package, our carrier will start an investigation and we will proceed to send a new order if all the products are available. In these cases, the response time of our carriers usually ranges from one to three weeks, but if the lost package is not located and the garments cannot be replaced, the amount paid by the customer will be refunded.
The user must check the good condition of the package before the carrier that, on behalf of Diseño y Fantasía S.L. (GISELA), makes the delivery of the requested product, indicating on the delivery note any anomaly that may be detected in the packaging. If, subsequently, once the product has been checked, the user detects any incident such as a blow, breakage, signs of having been opened or any damage caused by the shipment, the user undertakes to notify Diseño y Fantasía S.L. (GISELA) via email as soon as possible and within a maximum of 7 working days from delivery.
B.11) Buyer's rights and return policy
PRODUCT AVAILABILITY
Diseño y Fantasía S.L. (GISELA) informs the user that the number of units available at the beginning of the sales of each collection have been reserved for it.
Diseño y Fantasía S.L. (GISELA) will make every effort to please all its users in the demand for products. However, sometimes, due to causes beyond the control of Diseño y Fantasía S.L. (GISELA) such as human error or incidents in computer systems, it is possible that the final amount in inventory may be less and therefore it will not be possible to proceed with the sale.
In the event that the product is not available after the order has been placed, the user will be informed by phone or email of the total or partial cancellation of the order. Partial cancellation of the order due to unavailability does not entitle the user to cancel the entire order. If as a result of this cancellation the customer wants to return the delivered product must follow the stipulations in the returns section.
RETURN POLICY AND PRODUCT WARRANTY
Conditions for return or exchange
Did you receive your order and a garment doesn't fit you properly? Don't worry, here you have all the information to make the return, but there are several conditions that the product must meet:
- Must not be used.
- It must not have suffered any type of damage.
- We also do not accept the return of panties for hygienic reasons.
- It must have its label and the packaging must be the same box in which we sent it to you or a similar format.
- Accessories cannot be returned (adhesive fasteners, socks, earrings...).
- The bikinis can be returned as the bottom comes with a hygienic protector.
- Products containing a gift box must also be returned in the event of a product return.
- Bra and panty packs are non-returnable due to hygiene issues.
- Indoor bodysuits cannot be returned for hygiene reasons.
How can I make a return or exchange of size or color?
- Orders placed within the Peninsula, Portugal and Balearic Islands:
You can make your return here, or if you have an account log in to your profile, access your account and in the orders section, find your order, click on return, and select the item/s you want to exchange or return. You can choose to deliver your return to a delivery point enabled for this purpose or the transport agency will come to your address to pick it up. We will send you an email with the information and a sticker attached for you to print and paste on your package. Once you receive this email, you have up to 5 days to deliver your return. After that time, the sticker will not be valid and you will not be able to return the order. Once the return arrives at our facilities and we check that everything is correct, we will send the new garment or in the other case, the refund of the corresponding amount.
- Orders placed in the Canary Islands and international shipments:
No returns, size or color changes will be possible.
- Store returns:
Currently we only have one physical store and it is in Malaga. If you want to return an order and you are in Malaga, you can go to our store in C/Nueva nº9.
The process is very simple, you just have to go to our store with the products you want to return and the purchase receipt. They will process the return (you do not need to process it through the web) and will inform you of the refund process. In case you want to change the size, you will have to make a new purchase.
Exchanges and/or returns can only be made through the procedures described above, through the parcel and transport company we work with. In case of not managing the return following the established procedure, the customer will be solely responsible for any additional costs that such return may generate.
How can I make a return?
If you placed your order by logging in, you must access your account and in the section orders and returns, find your order, click on view order and choose the item/s you want to return. You can choose to deliver your return at a post office or have the courier pick it up at your address. We will send you an email with the return information and an attached sticker that you must print and paste on your package. Once you receive this email, you have up to 5 days to deliver your return. After that time, the sticker will not be valid and you will not be able to return the order.
How long does it take to return or exchange a size?
You have up to 15 days to make your return, counting from the day the carrier made the delivery. Once you receive the email with the return information and the attached sticker, you have up to 5 days to deliver your return. After that time, the sticker will not be valid and you will not be able to return the order.
How will I receive my refund?
Depending on the payment method you used, we will reimburse you as follows:
- Card: you will receive a credit to the account associated with your card, which you will be able to check on your card statement.
- Paypal: You will receive a credit to your PayPal account.
- Cash on delivery: we will make a transfer to your bank account. During the return process we will ask you for some bank details (IBAN/BIC). In case of placing your order as a guest you must indicate in the email info@gisela.com your bank account number in order to make the transfer corresponding to the return.
When will I receive my refund?
Once we receive the return and check that everything is correct, we send an email with the confirmation of arrival and within 4 to 8 days, you will receive the refund of the corresponding amount through the same payment method you used to make your purchase.
Please note that the refund may take several days to appear in your transactions, as it depends on your bank and not on gisela.com.

www.gisela.com accepts order cancellations by phone or email. You can also make a cancellation by accessing the "my account" section and proceeding to the refund.

The client of Diseño y Fantasía S.L. (GISELA) undertakes at all times to provide truthful information about the data requested in the user registration forms or order placement, and to keep them updated at all times. The customer agrees to accept all the provisions and conditions contained in these General Conditions of Contract, understanding that they reflect the best possible service for the type of activity carried out by Diseño y Fantasía S.L. (GISELA).

Purchases and sales made with Diseño y Fantasía S.L. (GISELA) are subject to the laws of Spain. In case of any conflict or discrepancy, the applicable jurisdiction shall be the Courts or Tribunals of the seller.

2. Ámbito territorial y personalPodrán participar las personas físicas mayores de 18 años, con domicilio en España (Península y Baleares). Quedan excluidos empleados de Gisela, colaboradores directos del Sorteo y sus familiares de primer grado.
3. FechasEl Sorteo estará activo desde las 00:00 h del 16 de noviembre hasta las 23:59 h del 18 de noviembre de 2025 (hora peninsular española).
4. Mecánica de participaciónParticipan automáticamente todas las personas que realicen un pedido con un mínimo de dos (2) unidades exclusivamente en la categoría “Sport” de gisela.com dentro del periodo indicado.Una (1) participación por pedido válido.Si el pedido se cancela o se devuelve íntegra o parcialmente de forma que quede por debajo de 2 unidades, la participación queda anulada.Se contabilizan únicamente unidades compradas (no se incluyen obsequios, unidades gratuitas de promociones tipo 2x1, ni cupones regalo como unidad adicional).Gisela podrá requerir justificantes de identidad y del pedido para validar la participación.
5. Premio1 (un) par de zapatillas Munich (modelo y color sujetos a disponibilidad), con elección de talla entre las disponibles en el momento de la gestión.Premio personal e intransferible, no canjeable por dinero ni por otros productos/servicios. No se admitirán cambios de talla/modelo una vez enviado salvo defecto de fabricación conforme a la normativa aplicable.
6. Selección del ganador/a y suplentesEn los 7 días naturales siguientes a la finalización, Gisela realizará un sorteo aleatorio entre todas las participaciones válidas y designará 1 ganador/a y 2 suplentes. La selección se documentará internamente mediante herramienta de aleatorización o sistema equivalente.
7. Comunicación y entrega del premio: Gisela contactará al ganador/a por correo electrónico y/o teléfono asociados al pedido en un plazo máximo de 72 horas tras el sorteo.El ganador/a deberá aceptar el premio respondiendo en un plazo de 72 horas desde la comunicación. En caso contrario, o si no cumple las Bases, el premio pasará al primer suplente, y así sucesivamente. Envío sin coste dentro de España (Península y Baleares). Gisela no responde de incidencias de transporte ajenas a su control.
8. Fiscalidad: El premio queda sujeto a la normativa fiscal vigente. En su caso, Gisela practicará las retenciones o ingresos a cuenta exigibles, correspondiendo al ganador/a declarar el premio conforme a derecho.
9. Protección de datos:

10. Publicación del ganador/a y uso de nombre/imagen: Con la aceptación del premio, el ganador/a autoriza a Gisela a mencionar su nombre/alias y localidad en los canales propios (web, newsletter y RR. SS.) para comunicar el resultado. Cualquier uso de imagen/testimonio requerirá consentimiento adicional.
11. Fraude y descalificación: Gisela podrá excluir a quienes actúen de forma fraudulenta, abusiva o contraria a estas Bases, o impidan su normal desarrollo.
12. Modificaciones y cancelación: Gisela podrá modificar estas Bases o cancelar el Sorteo por causa justificada de fuerza mayor o imposibilidad sobrevenida, sin perjuicio de los derechos ya adquiridos.
13. Responsabilidades: Gisela no será responsable de fallos técnicos de internet, plataformas de pago o mensajería ajenos a su control. Munich es marca de su titular; este Sorteo no está patrocinado, avalado ni administrado por Munich salvo indicación expresa.
14. Aceptación de las Bases: La participación implica la aceptación íntegra de estas Bases. Cualquier cuestión no prevista será resuelta por Gisela conforme a la buena fe y la normativa aplicable.
15. Ley aplicable y jurisdicción: Estas Bases se rigen por la ley española. Salvo norma imperativa en contrario, las partes se someten a los juzgados y tribunales de Málaga.
